Eligibility

To use exaimax services you must have the legal capacity to enter into contracts under applicable law and comply with these Terms. Use of services for unlawful purposes is prohibited.

Users must be at least 20 years old to engage in contractual services related to property transactions in Thailand unless acting through a legally authorized representative.

You agree to use exaimax services only for lawful purposes and in a manner consistent with applicable Thai law and local regulations governing real estate transactions.

Some services or features may not be available in all jurisdictions. It is your responsibility to ensure compliance with local regulations when using our services.

Accounts and access

Certain features require creating an account. Provide accurate and up-to-date information when registering and maintain the security of your credentials.

You are responsible for the accuracy of information provided to exaimax. Incorrect or incomplete information may affect our ability to provide services effectively.

Protect your account credentials and notify exaimax immediately if you suspect unauthorized access. We employ reasonable security measures but cannot eliminate all risks associated with online transmission or storage.

Accounts are personal and non-transferable unless explicitly arranged with exaimax in writing.

If you believe your account has been compromised, contact support immediately at +66993183723 and follow the account recovery procedures on exaimax.digital.

exaimax may suspend or restrict access to accounts that violate these Terms, for security reasons, or to comply with legal obligations. We will provide notice when appropriate and practicable.

Service scope

exaimax provides professional support, documentation review, coordination with local authorities, and advisory services to facilitate real estate transactions in Thailand. Services are consultative and based on information provided by clients and third parties.

We may modify the scope, features, or availability of services. Material changes will be communicated to affected users via email or notices on exaimax.digital.

We strive to maintain service availability but do not guarantee uninterrupted access. Downtime for maintenance or circumstances beyond our control may occur.

User rules and conduct

When using exaimax services you must comply with the following rules. Breaches may result in suspension or termination of services.

• Provide truthful, complete and accurate information required for transaction processing.
• Do not use our services to submit forged, fraudulent or unlawful documentation.
• Respect intellectual property rights and do not upload content that infringes third-party rights.
• Refrain from automated scraping, bulk extraction, or disruptive technical activities against exaimax systems.
• Comply with applicable laws, including anti-funds laundering and taxation rules relevant to property transactions in Thailand.
• Cooperate with reasonable verification requests to establish legal identity or ownership where required by law.
• Use communication channels professionally and do not harass, abuse or threaten staff or other users.

User content

You may submit documents, images, and other content as part of a transaction. You retain ownership of materials you provide subject to the license below.

You represent that you have the right to submit the content and that submission does not violate third-party rights or applicable laws.

By submitting content to exaimax you grant a non-exclusive, revocable license to use, reproduce and transmit such content solely for the purpose of delivering the requested services and complying with legal obligations.

You are responsible for maintaining copies of original documents and for the integrity of materials submitted. exaimax will handle supplied documents with commercially reasonable care.

We may remove content that violates these Terms or is unlawful. Where appropriate, we will notify you and provide a mechanism to resolve disputes over removed content.

Intellectual property

All intellectual property rights in the exaimax brand, website design, software, and proprietary materials remain the property of exaimax or its licensors. You may not use our activity or materials without prior written consent.

• Do not copy or redistribute proprietary content from exaimax.digital for commercial use without permission.
• Do not reverse engineer, decompile, or attempt to extract source code from exaimax software components.
• Do not remove or alter copyright, activity or other proprietary notices on materials from exaimax.

Paid services

Certain services provided by exaimax are fee-based, including document preparation, official filings, and enhanced advisory support. Fees and payment terms are set out in service agreements or invoices.

Pricing is provided in advance where practicable and reflects the scope of work, local authority fees, and third-party charges. Estimates are based on information available at the time of engagement.

Payments are due in accordance with the terms on invoices or engagement letters. Accepted payment methods are indicated on invoices and on exaimax.digital during the checkout process.

Subscription or retainer arrangements, where offered, will be governed by separate subscription terms and automatic renewal provisions where applicable.

Refunds, where applicable, will be assessed on a case-by-case basis in accordance with the nature of the service performed and any third-party costs incurred.

Cancellation terms depend on the service and are specified in the engagement agreement. Some administrative fees may apply to cover costs already incurred.

Clients are responsible for any applicable taxes, duties, or government charges arising from services. exaimax will itemize taxes on invoices where required by law.

Prices may be adjusted to reflect changes in local fees, regulatory requirements, or input costs with notice to affected clients.

Non-payment may result in suspension of services, withholding of documents, or referral to collections where permitted by law.

Limitation of liability

To the extent permitted by law, exaimax's liability for direct damages arising from our services is limited to amounts paid for the relevant service. We are not responsible for indirect, incidental or consequential losses, including lost benefits, except where prohibited by applicable law.

Third-party providers

We may engage third-party professionals for inspections, notarization, or local filings. Those providers are independent and exaimax is not liable for their acts or omissions. Selection is made using due diligence and professional judgment.

Termination

Either party may terminate an engagement in accordance with the terms of the service agreement. Termination does not affect obligations that accrued prior to termination.

On termination, outstanding fees and expenses become payable and exaimax may retain copies of records as required by law. We will cooperate to transition active matters as appropriate.

Privacy and data protection

Our handling of personal data is governed by the Privacy Policy available at exaimax.digital/privacy. The policy explains what data we collect, how we use it, and how you can exercise your rights.

Communications

By providing contact details, you consent to receive communications related to service delivery, account administration, and important notices. For marketing communications you may opt out as described in our privacy policy.

Changes to terms

We may update these Terms to reflect legal, operational, or business developments. Significant changes will be posted on exaimax.digital and communicated to active clients where appropriate.

Governing law

These Terms are governed by the laws of Thailand. Parties agree that Thai courts have jurisdiction to resolve disputes, subject to any alternative dispute resolution arrangements agreed in writing.

Dispute resolution

Clients and exaimax will seek to resolve disagreements informally through negotiation. If unresolved, disputes may proceed to mediation or litigation under Thai law as specified in the service agreement.
